www.expandlabs.ro

The products and longevity services available on the www.expandlabs.ro platform are offered by EXPAND LABS GROUP S.R.L., with headquarters in Bucharest, 1st District, Str. Borsa 1-3, Bl. 10E, Sc. 2, Ap. 26, Cam 3, with UIC RO49210277, registered in the Trade Register under no. J40/23467/2023, hereinafter referred to as "Expand Labs" or "the Provider".

These Terms and Conditions apply to the sale of products and services through the online platform www.expandlabs.ro and to the making of appointments in order to benefit from the longevity services provided by Expand Labs.

By accessing and browsing our website, placing an order or making an appointment, pre-registering or contacting Expand Labs, you are deemed to have read, understood and accepted the Terms below in their entirety as a Consumer or as a Beneficiary of Expand Labs services.

Expand Labs reserves the right to make changes to the content of this Site and these Terms and Conditions without any prior notice to Consumers.

If there are any differences or disagreements between us, Expand Labs, as the Provider, and you, as the Customer, regarding the use of the www.expandlabs.ro Site, the Terms and Conditions in effect at the time of your use of our online platform will apply.

I. Definitions

For a proper interpretation of the Terms and Conditions of use of the website www.expandlabs.ro, as well as the rights and obligations arising from the acceptance thereof, the following terms shall have the following meanings:

„Campaign” – the action of Expand Labs to display for commercial purposes a finite number of Products/Services (gift cards [vouchers], packages, subscriptions, etc. that can be purchased online through the Website), having a limited and predefined stock, for a limited period of time set by the Provider;
„Order” – an electronic document that acts as a form of communication between the Provider and the Beneficiary by which the Beneficiary transmits, via the Site, his/her intention to purchase the Products and/or Services available on the Site;
„Commercial and marketing communications” – any type of message sent by Expand Labs (e.g. via e-mail) containing general and thematic information closely related to the Provider's activity, information on products or services similar or complementary to those you have purchased, information on offers or promotions, information on products added to the "Shopping Cart" section and other commercial communications such as: specialized articles or relevant information on products and services marketed through the Site;
„Consent” - means any freely given, specific, informed and unambiguous expression of will by the data subject by which he or she consents, by an unequivocal statement or action, to the processing of personal data relating to him or her;

„Content” includes the following elements:

the content of any newsletter or email received from Expand Labs by electronic means and/or any other available means of communication;
data relating to the Provider;
information related to the Products/Services, their validity and/or the prices charged by the Provider in a given period;
any information communicated by any means whatsoever by an employee/collaborator of the Provider to the Client, in accordance with the specified contact information;
all information on the Site that can be visited, viewed or otherwise accessed through the use of digital equipment;

,,Digital content’’ – data produced and provided in digital format, in particular Gift Cards (vouchers) and Service Packages that can be purchased electronically through the Site;

„Distance/ remote contract” – any contract concluded between the Provider (Expand Labs) and the consumer within the framework of an organised distance sales or service provision scheme, without the simultaneous physical presence of the trader and the consumer, with the exclusive use of one or more means of distance communication, up to and including the moment the contract is concluded;
„Shopping Cart” – section of the Site that allows the Consumer to add to the virtual shopping cart the Products/Services he/she wishes to purchase at the time of their actual addition or at a later time;
„Customer”/ „Consumer’’/ ,,Beneficiary”- any user who accesses the Site, interacts with it or places an order for Products/Services through it;
„Personal data” - any information relating to an identified or identifiable natural person ("Data Subject"), which may include: first and last name, e-mail address, telephone number, bank account details, health data, etc.;
„Document” – these Terms and Conditions;
„Inquiry’’/ ,,Message” – form of address to the Provider with the purpose of obtaining information about the Products and Services available on the Site. Such questions/ messages are generally sent by using the chatbot implemented on the Site, through the Contact Form available, respectively by making telephone calls to the Provider or by sending an e-mail in this regard;
„Offer” - the offer of Products or Services at special promotional prices, made available to Consumers by the Provider through the Site;
„Personal Data Controller” – means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of processing personal data;

„Online market” - a service using software, including a website or part of a website or an application operated by or on behalf of the merchant, that enables consumers to enter into remote contracts with other merchants or consumers;
„Data processing” - means any operation or set of operations which is performed on personal data or on sets of personaldata, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction (representing any kind of operation related to personal data);
„Provider” – the company Expand Labs Bucuresti S.R.L., having the above identification data;
„Product/ Service” – any good (including digital elements) or service specific to the Provider's business, offered by the Provider, available for purchase through the Site;
„Answer” – written/verbal information transmitted to the Consumer who has asked a question via the Site/by telephone/by e-mail/by chatbot;
„Service” - the e-commerce service conducted exclusively on the publicly available portions of the Site, in the sense of granting the possibility to the Consumer to contract the presented Services using exclusively electronic means; specifically, the Service consists in the purchase of Expand Labs Products/Services, following the placement of the order by the Customer; also, the Service refers to the making of appointments at Expand Labs level, i.e. the possibility to pre-register Beneficiaries to benefit from the Provider's services;
„Transaction” – the collection of the consideration for the Products/Services purchased, resulting from the sale or purchase of the same through the Site;
„Website”, „Online Platform” or „Site” – the website www.expandlabs.ro.

II. Contact

In order to contact us, Expand Labs publishes on the Site complete and correct identification data. Thus, you can contact us using the following means:

via the contact form available in the Contact section of the Website;
via the chatbot available on the Site in the section Ask a question.

By sending e-mails, making phone calls, sending messages using the contact form or chatbot, or sending notifications to Expand Labs, or by any other means available, you consent to receive notifications from us by any means available in relation to the contact information provided, including by electronic means, by telephone or by advertisements on the Site. These communications do not amount to the sending of newsletters, in which case your specific consent is required.
Expand Labs reserves the right not to respond to all requests of any nature, received by any means of communication, especially if they are unfounded/abusive.
No defamatory, threatening, invasive of another's privacy, hateful, racially, ethnically or otherwise offensive content or any other action contrary to applicable law will be accepted in any form of communication.
By providing your contact details (e-mail address, first and last name, telephone number, etc.), you expressly declare that the contact details provided belong to you and that we may use them in communications with you.
When contacting us, you will refrain from transmitting obscene, illegal, threatening, defamatory, privacy-invasive, virus-containing, political/electoral campaigning or any form of SPAM content.

III. General Policy

Online sales policy

This Document sets forth the Terms and Conditions of use of the Site/Content by you, unless you have another valid user agreement entered into between you and Expand Labs.

Therefore, please review this Document carefully to avoid any possible misunderstandings arising from your use of the Site.

Access to the Site and subscription to the Expand Labs newsletter is free of charge for any person who has reached the age of 18 and who is interested in the Products and Services in the Provider's portfolio.
Your use, including but not limited to accessing, visiting and viewing the Site, placing an order or subscribing to the newsletter implies your express agreement to accept these Terms and Conditions, unless there are separate terms of use between Expand Labs and you.
Access to Expand Labs Products and Services is made by accessing the Website, respectively by making phone calls to the numbers indicated on the Website, in order to schedule an appointment for the therapies offered by Expand Labs, or by physically presenting the Beneficiary at the Expand Labs office or by requesting an appointment via chatbot.
The actual purchase of the Products / Services will be made once all the formalities for placing and paying the desired order have been completed. Placing orders on the www.expandlabs.ro website can be done with or without creating a user account. However, the Beneficiary has the possibility to create an account at the time of placing the order in order to log in for future purchases.
The confirmation of the purchase of Expand Labs Products and Services will be done immediately after the completion of all formalities for placing and paying your order. The actual delivery of the purchased Services will be carried out at the Expand Labs headquarters, at the above mentioned address.
In order to place an order your acceptance of the provisions of this Document will be required. In the absence of your consent, we will be unable to take and honor any order placed by any means of remote communication.
If you place an Order for Products and/or Services on the Site, you are responsible for all actions arising out of such placement. The information you provide in the context of placing an Order must be accurate, true and complete. Thus, you must provide the following information correctly: name and surname, telephone number, e-mail address, exact and complete billing address, respectively name and surname and e-mail address used to place the order, if they are different from the billing address, as well as any other information necessary for the operation of the Orders placed.
Expand Labs is not responsible for the accuracy of the information submitted in order to deliver the Products and Services you have purchased. Lack of the necessary information or incorrect/false information will make it impossible for Expand Labs to contact you and/or to honour your order or to provide you with Expand Labs services.
When you opt to create a user account, you are solely responsible for providing correct identification and contact details.
Expand Labs may publish and promote on the Site Products/Services offered at special promotional prices. These are valid for a certain period of time, deemed appropriate and reasonable by Expand Labs, or within the availability of Expand Labs staff, as applicable.
If you do not agree and/or do not accept and/or revoke your acceptance hereof, you waive: access to the Service, any other Products and Services offered through the Site, receipt of communications from the Provider of any kind (electronic, telephonic, etc.), without any further warranty of any kind from Expand Labs.
You may at any time withdraw your decision to agree and/or accept the Document in the form in which it is then available.
In order to exercise the aforementioned right, you may contact us by sending an e-mail to contact@expandlabs.ro stating the reasons and/or requests for changes.
You will not be able to revoke your consent to the Document during the term of a Remote Contract or until you have paid all outstanding contracts to Expand Labs.
In the event that you have paid the consideration for all outstanding Contracts to Expand Labs and you revoke your consent to the Document during the term of an Order, Expand Labs will cancel the Order without any further obligation of either party to the other or without either party being entitled to claim damages against the other.
As a data subject you have the right, in accordance with the legal provisions on the protection of personal data, to request the deletion of your personal data processed by Expand Labs, subject to the applicable legal provisions on archiving and accounting which may impose specific time limits for data retention (for example, in the case of tax documents). For more information on the processing of personal data and your rights as a data subject, we invite you to access the GDPR section available on the Site, as well as our Privacy Policy. If you no longer wish to receive newsletters/alerts and/or communications for marketing and advertising/promotional purposes, you may send us an unsubscribe request available in any communication sent via e-mail or by sending a written request to: contact@expandlabs.ro.
Expand Labs may limit/suspend access to the Site, or the use of existing accounts and restrict/suspend access to the Products and Services sold through the Site, including by cancelling orders placed and not fulfilled by the Provider, in case of reasonable suspicion of fraud, as a result of misuse of the Site or in case of damage to the interests of the Provider, its collaborators or partners.
Expand Labs is not responsible for any errors in the display of the Site or for any graphics displayed on the Site which are found to be erroneous or cannot be viewed.
All the information used for the visual description of the Products and Services available on the Site (static/dynamic images/multimedia presentations etc.) does not represent a contractual obligation on the part of Expand Labs, as they are used exclusively for presentation purposes and may contain errors or differences in representation. We may at any time change the details of our Products and Services available online.
Expand Labs assumes no responsibility for suspension or interruption of the operation of the Site.
By using the Site/Content/Service, you are solely responsible for all activities that result from your use of the Site/Content/Service. You will also be liable for any material, intellectual, electronic or other damage caused to the Site/ Content/ Service, to the Provider or to any third party or partner with whom Expand Labs has entered into contracts or with whom it has a collaborative relationship, in accordance with applicable national law.
Expand Labs shall not be liable for any loss, costs, suits, claims, expenses or any other damages, if they are directly caused by non-compliance with the Terms and Conditions.

IV. Validity of Tenders, Products and Services

Expand Labs reserves the right to change the prices charged for Products and Services available on the Site without prior notice to you individually. However, the price displayed on the Site at the time of placing the Order will not change, as it is firm.
The purchase price of the Promotional Products/Services is the one at the time of placing the Order, within the limit of available stock or the promotional period announced by the Provider, as the case may be.
The purchase price of the Products/Services in an Order issued may not be changed at a time subsequent to its issuance except with the agreement of the parties.
The purchase price of the Products in an honoured Contract may not be changed.
We mention that we may limit the ability to purchase some products or services available on the Site at a given time, to one or more Consumers, for justified reasons.
All prices for products or services presented on the Site are expressed in lei (RON) or EURO (EUR) and include or not VAT, depending on the services chosen.
All subscriptions purchased through the Site are valid for a set period, so that within this period, which is calculated from the purchase of the subscriptions, the Beneficiary is obliged to perform the therapies included in the purchased subscription. The validity period will be displayed on the website.
Packages and gift cards (vouchers) available on the Website are valid for a set period, calculated from the moment of purchase. The validity period will be displayed on the website.
We draw your attention to the fact that the gift cards (vouchers) offered by the Provider are nominal, so that only the Beneficiary of the voucher will benefit from the services purchased through the voucher, and not his/her spouse, parent, sister, brother, child, etc.

V. Online ordering

Through the Website, Consumers can place orders for Products and Services of Expand Labs, in particular for Service Packs, Subscriptions and Gift cards and other goods and services available on the website.
Placing an order for Expand Labs Products and Services does not imply the automatic scheduling of the services (therapies) in question. In this regard, we invite you to contact us at the contact phone numbers, via the chatbot, or follow the steps available in the section ,,Online Appointments'' to make an appointment.
Any appointment will be made within the limit of available places in a certain period of time, in the effective order of the appointment.
The products and services available on the Site may be purchased for personal use or for another person. In the latter case, we invite you to fill in the appropriate identification and delivery data in order to honour the order, after ticking the box with the text "Do you deliver to another address?".
The Consumer understands that the Gift Cards purchased, respectively the Service Packages, can only be used at the Provider's premises, given the nature of the services offered by the latter, which imply the physical presence of the Beneficiary.
In all cases, in order to benefit from the purchased Services, we invite you to contact us at the phone numbers available on the website, respectively through the chatbot or the specific form in order to make an appointment.
Prior to the scheduled date, you will receive an SMS to confirm your appointment, which will include both the date and time set for the presentation at Expand Labs.
As well as the SMS provided for in point. V.7. above, appointments must be confirmed by the Client within 2 hours of receiving the appointment SMS from the Provider. Otherwise (if the appointment is not confirmed or is confirmed after the 12 hours granted by the Provider), the Client understands that his/her appointment is automatically cancelled and deleted from the Provider's records.
Simply adding a Product/Service to the shopping cart does not constitute completion of the Order. The Order will be completed only after full payment has been made for the Product and Service selected for purchase.
The fields of the order form must be filled in correctly and completely with real and updated data, if they are not pre-filled with the information available in the User Account.
You are fully responsible for the accuracy and veracity of the data entered. Expand Labs is not responsible for any error in placing the order, i.e. non-delivery/ wrong delivery of the purchase information of the Products/Services ordered due to wrongly entered data. Thus, we invite you to check the data entered prior to placing the order and update them, if necessary, if they are not correct or true.
In the event of a minor error in filling in the telephone number or e-mail address (a wrong letter, a missing letter, an extra letter/digit, etc.), please contact us as soon as possible at the contact details available to remedy the situation.
Payment for the Products and Services selected for purchase can only be made by using a bank card, through the payment processor.
After successful completion and placement of the Order, you will receive a confirmation e-mail with the details of the Order, together with the tax invoice for the purchase.
For any order placed, the Customer is obliged to read this Document in its entirety, and may not claim ignorance of the contractual clauses applicable to the relationship between the parties in the event of any misunderstandings arising after the conclusion of the distance contract.
By completing the Order you agree that all data provided by you, necessary for the purchase process and to benefit from the purchased services, are correct, complete and true at the time of placing the Order.
Following the placement of the Order and its subsequent validation by Expand Labs, we will issue and send you all necessary documents proving the purchase of the Products and Services in accordance with the legislation in force.
By placing your order you agree that we may contact you for the following purposes/situations, by any available/agreed means:
- Validation of the availability of the Products/Services purchased and the intervals for which therapy is opted for;
- Order confirmation;
- Validation by you of the order value;
- Mutually agree on the details of the electronic delivery of the Products;
- Establishing the necessary scheduling details for the Products/Services purchased;
- Any other situation in which it is necessary to contact you for the validation and delivery of your order.
If you change your personal data, all ongoing contracts existing at that time retain the data defined/accepted before the time of the change, except for informing the Provider, preferably by telephone, as soon as possible before the actual delivery of the products.
Validation of the Order and delivery of the Order shall be made only if:Your details are complete and correct;
- Your details are complete and correct;
- The Products and Services in your order are available;
- There are no errors in the system that could generate wrong prices (e.g.: zero price value/Lei).

Aceste date vor fi folosite excusiv in relatia dintre Expand Labs si tine pentru inregistrarea, procesarea si prelucrarea Comenzii, pentru efectuarea unei programari la sediul acestuia, dar si pentru solutionarea reclamatiilor ulterioare si furnizarea de informatii necesare in legatura cu Produsele si Serviciile Expand Labs/ Comenzile plasate. Acestor prelucrari de date efectuate de Expand Labs le sunt aplicabile prevederile GDPR disponibile pe Site.
The distance contract is considered concluded between the parties when the order placed by you is confirmed electronically by Expand Labs, thus applying the relevant legal provisions, to which these Terms and Conditions are attached, but not limited to.
We reserve the right to automatically cancel an order placed, with your immediate or subsequent notification, but at the earliest opportunity, without any further obligation of either party to the other or without either party being able to claim damages from the other, in the following cases:

- Data provided by you on the Site is incomplete or incorrect;
- Your activity on the Site (may) cause damage of any kind to Expand Labs and/or its partners or collaborators;
- Failure/ invalidation of the online transaction;
- Non-acceptance by the payment processor/issuing bank of your bank card for the transaction;
- More than 3 confirmed and unfulfilled appointments;
- The order is not validated by you when we contact you for this purpose;
- If there is a reasonable suspicion of fraud, as a result of misuse of the Site or in case of damage to the interests of Expand Labs and/or its collaborators or partners.

VI. Payment and delivery

Payment for the services purchased can only be made online, by bank card.
All prices for products or services presented on the website are expressed in lei (RON) or EURO (EUR) and include or not VAT, depending on the services chosen.
Transactions are carried out exclusively through the payment processor.
For online card payments, the Provider is/cannot be held liable for any other additional costs incurred by the Client, including but not limited to currency conversion fees applied by the issuing bank of the Client's card, if the issuing currency of the card differs from RON. You are solely responsible for this action.
Expand Labs does not request or store any information about your card, which is processed directly on the servers of the online payment service provider. In this context, we invite you to consult the policies applicable to the payment processor.
After processing your payment, we will send you an invoice for the Products and Services purchased to the e-mail address provided.

VII. Limitation of the Provider’s liability

Each Consumer is directly responsible for carrying out his/her own independent assessment of the Products and Services presented on the Site.
The Provider assumes no responsibility for potential malware that may infect your computer or other property on account of your access to or use of this Site or your downloading of any material, information, text, video or audio from it.
Expand Labs is not responsible for covering third party claims of any nature whatsoever that may arise in connection with the use, copying or forgery of the Site or its content by third parties unauthorized by Expand Labs, whether or not Expand Labs was informed, knew or should have known of the possibility thereof.
Consumers understand and accept that, due to the specific characteristics of the Internet and the Service, the Site administrator cannot confirm/guarantee the identity of Users and the truthfulness, accuracy, validity of any information or content provided by them on the Site. Consequently, Expand Labs cannot be held liable in any way and to any extent with respect to such information or any other legal/commercial effects arising from its use.
Expand Labs cannot be held liable for any kind of damage (direct, indirect, accidental, etc.) resulting from the use/inability to use the content information presented on the Site or for any kind of errors or omissions in the presentation of the Content that may lead to any kind of loss.
If you believe that any Content sent by any means by Expand Labs infringes your copyright or any other rights, please notify us at contact@expandlabs.ro, so that we can check for and remedy any infringements.
We do not grant you access to the Site or the Service and we do not grant you, without Expand Labs' written consent, the right to download, modify part and/or all of the Content, reproduce part and/or all of the Content, copy, exploit any Content in any other way, transfer to any third party any Content to which it has and/or has obtained access under a user agreement.
Expand Labs is not responsible for the content, quality or nature of other sites linked to from the Content, regardless of the nature of such links. For those sites, the entire responsibility is borne by their owners.
Expand Labs shall not be liable in any way for any damages resulting from purchases/offers/promotions/promotions/collaboration/any other relationship that may arise between you and any other third party that directly/indirectly promotes through the Platform.
Expand Labs makes no direct or indirect warranties that:

the Service will be suitable to the Consumer's requirements;
the Service will be uninterrupted, secure or error-free of any kind;
products and services will meet your subjective requirements or expectations of the Consumer.

VIII. Return policy for ordered products

Given the nature of the Products/Services marketed by Expand Labs through the Site, you understand and accept that they cannot be returned based on the exercise of the right of withdrawal from distance contracts because they are not tangible, material goods, but involve the provision of a therapy for which your presence at the Provider's premises is required.

IX. Guarantees

Due to the nature of the Products and Services offered by Expand Labs, they cannot be returned for reasons of non-conformity that would entail obligations for the Provider as they are not tangible goods, the guarantee referring, in fact, to the initial condition of the products.
It is your responsibility to check the compatibility of your device with .pdf electronic formats if you choose to receive Gift Card (voucher) in electronic format and ensure that it can be opened via your electronic devices.

X. Intellectual Property

The Platform, i.e. all Content, including but not limited to design, static images, dynamic images, symbols, text and/or multimedia content, etc. presented on the Site are the exclusive property of Expand Labs or its collaborators/partners/affiliated companies, as the case may be.
Any item on the Site may be followed by the original title and/or any other notice required by the rightful owner of such Content, for which the Provider holds a license to use and/or publish, if applicable.
Expand Labs/collaborators/partners/affiliated companies benefit from all intellectual property rights, regardless of their nature (copyright and related rights or industrial property rights).
The name ,,Expand Labs'', its logos and associated symbols, as well as combinations thereof with any word, graphic symbol or in any other form, used on the Site, are registered trademarks and are the exclusive property of Expand Labs. They may not be used in any way by third parties without the prior written consent of the owner.
Without the consent of Expand Labs, you are prohibited from copying, distributing, publishing, transferring, modifying and/or altering, using, displaying and/or embedding any Content in any context other than the one originally intended by Expand Labs, removing any marks signifying intellectual property rights in any elements of the Site, and participating in the transfer, sale or distribution of any materials made by reproducing, modifying or displaying the Content.
Any Content to which you have and/or obtain access by any means is subject to the Document unless the Content is accompanied by a specific and valid use agreement between you and Expand Labs.
If you are granted the right to use a particular Content in the form described in a separate usage agreement, that right extends only to that Content, to the extent and for the period provided in that agreement.
No Content transmitted to you by any means of communication (electronic, telephonic, etc.) or acquired by accessing, viewing and/or browsing shall constitute a contractual obligation on the part of Expand Labs and/or our employee/collaborator who facilitated the transfer of Content, if any, with respect to such Content.
Any use of the Content other than as expressly permitted by the Document or the accompanying User Agreement, if any, is prohibited.
The consumer is liable for any intellectual damage caused to the Site, the Content, or any third party with whom Expand Labs has contracts or with whom it is in a collaborative relationship, in accordance with the national legislation in force.
In the unlikely event that a restriction resulting from the infringement of any third party right, in particular intellectual property rights, prevents or limits the use of the Site, you have the right to provide the Service/Content in accordance with this Document and the relevant legal provisions.

XI. Fraud and SPAM

Expand Labs will not ask you by any means of communication (email/telephone/SMS) for information regarding confidential data, accounts or personal passwords.
User account access credentials, if you have opted to create such an account, are personal and will not be shared with any third party.
You assume full responsibility for the disclosure of your confidential data to a third party.
We disclaim all liability in the event of any injury or damage in any form by a third party claiming to be/representing the interests of Expand Labs. In these situations, please inform us as soon as possible of any such attempts using the contact details.
Communications made by Expand Labs by electronic means of distance communication (i.e. e-mail/SMS) contain the sender's complete and accurate identification data or links to them at the time of transmission of the Content.
Expand Labs does not promote SPAM.
Communications made by Expand Labs by electronic means of distance communication (i.e. e-mail/SMS) contain complete and accurate sender identification data or links to it at the time of transmission of the Content.
The following types of actions will be considered as attempts of fraud/fraud:
- attempting to access/accessing another Consumer's data of any kind using an account or any other method;
- altering or modifying the content of the Site or Content sent by any method by Expand Labs to any Customer;
- impair the performance of the server(s) running the Site;
- access or disclose to any third party who does not have the necessary legal authority, Content sent by any means by Expand Labs to a Customer when you are not the lawful recipient of the Content.
Expand Labs reserves the right to pursue all available legal remedies in the event of a violation of its rights and legitimate interests.
You understand the importance of the following responsibilities and agree to the following:
- you will only provide true, accurate and complete data so that the process of purchasing the Products and Services listed on the Website can take place, as well as to actually benefit from Expand Labs services;
- you will maintain and update, when necessary, your registration data so that it is up-to-date, accurate and complete;
- you will not publish material that contains viruses or other programs intended to destroy the Provider's system or any information that is part of that system;
- you will not publish copyrighted material unless you are the author or have the author's permission to publish that material;
- you will not publish obscene, defamatory, threatening or malicious material, material or information prohibited by applicable law.
You may submit comments, notes, suggestions, ideas or observations regarding the content and structure of the Site, or ask questions as long as their content is not illegal, obscene, threatening, defamatory, infringing on the privacy or intellectual property rights of the Provider or third parties and as long as they do not contain viruses, political/electoral campaigning, commercial solicitation, chain letters, mass mailings or any other form of spam. You will not use a false e-mail address in communicating with Expand Labs.
Subject to the above, you may inform third parties (e.g. by email, Facebook, Twitter etc.) about the Offers made available through the Site.

XII. Major force and fortuitous event

Unless expressly provided otherwise, neither party to a concluded Contract which is still in force shall be liable for failure to perform on time and/or properly, in whole or in part, any of its obligations under the Contract, if the failure to perform such obligation was caused by an event of force majeure.
The party or the legal representative of the party claiming the aforementioned event is obliged to inform the other party immediately and completely of its occurrence and to take any measures at his/her disposal to limit the consequences of the event.
If within 15 days from the date of its occurrence, the said event does not cease, each party shall have the right to notify the other party of the termination of the Contract without either party being entitled to claim any further damages.
The party claiming force majeure must prove the impossibility of performance of the obligations within 15 days from the date of the event.

XIII. Disputes

The use, including but not limited to accessing, visiting, viewing the Site, or placing an Order implies your express agreement to these Terms and Conditions, unless there are separately formulated terms of use between Expand Labs and you.
The Contract is considered concluded in Romania and is governed by the legal provisions applicable in Romania.
We will try to resolve amicably any dispute with reference to these Terms and Conditions. If this is not possible, the conflict will be settled by the competent court according to the law.
If any of the above clauses is found to be void or invalid for any reason whatsoever, such clause shall not affect the validity of the remaining clauses.
Expand Labs shall not be liable for any losses, costs, suits, claims, expenses or other liabilities, if they are directly caused by your failure to comply with the Terms and Conditions.
This Document has been drawn up and shall be interpreted in accordance with Romanian law.

XIV. Final provisions

We reserve the right to make any changes to these provisions contained in the Document, as well as any changes to the Site/its structure/Content, without prior notice to you.
Expand Labs cannot be held responsible for any errors that may occur on the Site due to any cause whatsoever, including changes, settings, etc. not made by the Site administrator.
We reserve the right to place advertising banners of any nature and/or links on any page of the Site, in compliance with the legislation in force.
